October 20, 2010 Santa Rosa County School Board Engaged in More Questionable Activity http://lc.org/index.cfm?PID=14102&AlertID=1187 Liberty Counsel has uncovered troubling facts in the ongoing litigation against the ACLU and Santa Rosa County School Board over the notorious Consent Decree that has led to criminal prosecutions of school officials for mealtime prayers and forced teachers to pray inside closets to avoid criminal charges. The Santa Rosa County School Board and its superintendent have joined forces with the ACLU to defend the Consent Decree against constitutional challenge. Unsatisfied with the number of defendants, they have now brought in an additional defendant to oppose Liberty Counsel, namely the current Principal of Pace High School. Bryan Stephen Shell, the current principal who replaced the retired H. Frank Lay, had filed pleadings vigorously defending the Consent Decree that oppresses the teachers at his high school, filing a Motion to Dismiss and an Opposition to Plaintiffs’ Motion for Preliminary Injunction. Shockingly, however, Principal Shell apparently had no idea that these actions were being carried out in his name. In a filing made by Liberty Counsel with the federal court in Pensacola, Mr. Shell’s secretary and a teacher at Pace High School report that Principal Shell never authorized his office to participate in this lawsuit, never authorized any of the filings that were purportedly made in his name, and never even saw those filings before they were made. Mr. Shell is reportedly angry and upset that the school board and superintendent have hijacked his office and used his name to do their own bidding against the school district’s own employees. They enlarge the shroud of doubt over the actions of the Santa Rosa County School Board, the superintendent and the ACLU. Liberty Counsel will continue to expose these activities.
